Terms and Conditions

These Terms & Conditions ("Agreement") govern all access to and use of the CompassionCloud platform ("Service"), owned and operated by Vizie Designs LLC ("Provider"). By creating an account, accessing, or using the Service, the user ("User," "Church," "Organization," or "You") agrees to be bound by the terms of this Agreement.

If you do not agree to these Terms & Conditions, do not use the Service.

1. Use of the Service

1.1 Eligibility

Users must be authorized representatives of a church, nonprofit, or organization legally permitted to store and manage family, volunteer, or ministry-related information.

1.2 Church Responsibility

You acknowledge that all data entered into the platform—including family information, case notes, follow-up records, addresses, and other sensitive information—is entered voluntarily by your organization. You are solely responsible for:

  • the accuracy of the data you input,
  • obtaining consent where applicable,
  • ensuring all shared information complies with state and federal privacy laws.

1.3 Purpose of Service

CompassionCloud is a tool to assist churches and organizations in managing outreach activities. It does not replace professional judgment, case management expertise, legal processes, or mandated reporting responsibilities.

2. No Liability for Entered Information

2.1 User-Submitted Data

The Provider does not verify, monitor, or endorse any information entered by churches or users.

2.2 Church Responsibility for Sensitive Data

Churches acknowledge they are entering information that may be sensitive in nature and assume all legal and ethical responsibility for:

  • storage,
  • handling,
  • sharing,
  • and accuracy of that information.

2.3 No Liability

The Provider is not liable for:

  • incorrect or incomplete information entered by users,
  • decisions made by churches based on data within the platform,
  • any harm resulting from the misuse, misinterpretation, or unauthorized disclosure of user-submitted data.

The Church agrees to hold the Provider harmless from all claims related to data entered by Users.

3. Data Privacy & Security

3.1 Efforts to Protect Data

The Provider uses commercially reasonable security measures to protect stored data. However, no system is completely secure, and the Church acknowledges this inherent risk.

3.2 Church Accountability

The Church is responsible for:

  • controlling access to its user accounts,
  • managing team permissions,
  • ensuring passwords are secure,
  • maintaining confidentiality of account credentials.

3.3 Data Breaches

The Provider will make reasonable efforts to notify Users of any known system-wide breach, but is not responsible for:

  • breaches caused by weak user passwords,
  • user-side negligence,
  • unauthorized access on the church's end,
  • sharing credentials among staff.

4. Compliance With Laws

4.1 Church Responsibility for Compliance

The Provider does not provide legal advice. It is the church's responsibility to ensure its use of the Service complies with:

  • HIPAA (if applicable),
  • FERPA,
  • local privacy laws,
  • mandated reporter laws,
  • any other federal or state requirements.

4.2 Sensitive Information

The Service is not intended to store:

  • medical records,
  • social security numbers,
  • financial account numbers,
  • government identification numbers, or other regulated data categories.

Churches agree not to enter such information.

5. Account Responsibilities

5.1 Accuracy of Registration Information

The User agrees that all information provided during account creation is accurate.

5.2 Account Sharing

Accounts may not be shared between individuals. Each team member must have their own account.

5.3 Account Termination

The Provider reserves the right to suspend or terminate accounts for:

  • violations of these Terms,
  • misuse of the platform,
  • attempts to compromise system security.

6. Service Availability

6.1 No Guarantee of Uptime

The Provider strives for platform availability but does not guarantee uninterrupted access.

6.2 Maintenance & Updates

Scheduled or emergency maintenance may occur without notice.

6.3 Service Changes

The Provider may modify, update, or discontinue features at any time.

7. Limitation of Liability

To the maximum extent permitted by law, the Provider is not liable for any:

  • indirect, incidental, or consequential damages,
  • data loss,
  • system outages,
  • loss of ministry opportunities,
  • harm resulting from decisions based on information within the platform.

Total liability under this Agreement will not exceed the amount paid by the Church in the preceding 12 months, or $100 if no fees were paid.

Churches agree to indemnify and hold the Provider harmless from any claims arising from:

  • user-submitted data,
  • outreach activities,
  • family interactions,
  • volunteer or staff actions,
  • misuse of the Service.

8. No Professional Advice

The Service does not provide:

  • legal advice,
  • social work guidance,
  • counseling services,
  • crisis intervention,
  • mandated reporting decisions.

Churches agree they are solely responsible for all professional decisions.

9. Intellectual Property

All platform code, branding, features, and designs remain the property of the Provider. Churches receive a limited, revocable license to use the software.

10. Termination

Either party may terminate use of the Service at any time. All data belonging to the Church may be deleted following termination, in accordance with Provider policy.

11. Governing Law

This Agreement is governed by the laws of the State of Indiana.

12. Acceptance of Terms

By creating an account or clicking "I Agree," the User acknowledges:

  • they have read and understood this Agreement,
  • they are authorized to accept it on behalf of their church,
  • they agree to be bound by the Terms & Conditions.
